1. Who we are

These Terms of Service ("Terms") govern your use of the 10min TOCFL websites (10now.co and its subdomains), web application, and iOS application (together, the "Service"). By creating an account or using the Service you agree to these Terms.

2. The Service

10min TOCFL provides online study material for the Test of Chinese as a Foreign Language (TOCFL), including mock exams, practice questions, audio recordings and related tools. The Service is an independent study tool: it is not affiliated with, endorsed by, or connected to the Steering Committee for the Test Of Proficiency-Huayu (SC-TOP) or any official testing body, and using the Service does not guarantee any particular test result.

3. Accounts

Parts of the Service require an account, created by signing in with Google. You are responsible for activity under your account and for keeping your sign-in method secure. You must provide accurate information and be at least 13 years old (or the minimum age of digital consent in your country) to create an account.

You may delete your account at any time from the account settings in the app, or by contacting us. Deleting your account removes your personal data as described in our Privacy Policy.

Refunds are handled as described in our Refund & Cancellation Policy, which includes mandatory consumer rights that apply in your country (including the European Union and Taiwan). Nothing in these Terms limits consumer rights that cannot be waived under the law of the country where you live.

We may suspend or terminate accounts that materially breach these Terms. If we terminate your paid subscription without cause, we will refund the unused portion on a pro-rata basis.

7. Legal and export restrictions

The Service is a digital study tool and is not subject to specific export-control licensing; however, we do not offer the Service to persons or entities in jurisdictions subject to comprehensive sanctions or embargoes applicable to us (including under Singapore law and United Nations sanctions), or to anyone listed on applicable sanctions lists. By using the Service you confirm you are not such a person.

8. Intellectual property

All content in the Service — questions, explanations, audio recordings, images, software and design — is owned by us or our licensors and protected by copyright and other laws. We grant you a personal, non-exclusive, non-transferable licence to use the Service for your own study while these Terms are in effect.

9. Disclaimer and limitation of liability

The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, and our total liability for any claim arising out of the Service is limited to the amount you paid us in the 12 months before the claim arose. We are not liable for indirect or consequential loss. Nothing in this section excludes liability that cannot be excluded under applicable law (including under the Singapore Unfair Contract Terms Act or mandatory consumer law where you live).

10. Changes to the Service or these Terms

We may update the Service and these Terms. For material changes to these Terms we will give notice (by email or in-app) at least 14 days before they take effect. Continued use after that date constitutes acceptance; if you do not agree, stop using the Service and, if you have an active subscription, cancel it.

11. Governing law

These Terms are governed by the laws of Singapore, and disputes are subject to the non-exclusive jurisdiction of the Singapore courts — except that if you are a consumer, you keep the protection of mandatory consumer-protection rules, and may bring proceedings in the courts, of the country where you live.

12. Apple App Store

If you use the iOS app, these Terms are an agreement between you and us, not with Apple. Apple has no obligation to provide support for the app and is not responsible for it, but Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
